This Privacy Policy explains how Avanto Media LLC. (“Avanto,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when individuals visit Avanto.media, interact with Avanto advertisements, landing pages, lead forms, or other online services, or otherwise communicate with us (collectively, the “Services”).

This Policy is designed to address applicable comprehensive U.S. state consumer privacy laws and, where applicable to our activities, the EU General Data Protection Regulation (“EU GDPR”), the UK GDPR and related UK data-protection law, and the Swiss Federal Act on Data Protection (“FADP”). Privacy laws vary by jurisdiction and may apply based on statutory thresholds and other criteria. Nothing in this Policy expands rights beyond those provided by applicable law.

1. Information We Collect

Depending on how you interact with the Services, we may collect the following categories of personal information:

  • Identifiers and contact information, such as name, email address, telephone number, postal address, and ZIP code.
  • Internet and electronic network activity, such as IP address, browser and device type, operating system, referring URL, pages or advertisements viewed, clicks, form interactions, and timestamps.
  • Advertising and campaign information, such as campaign, source, publisher, affiliate, referral, click, and conversion identifiers.
  • Commercial and preference information, such as products or services in which you expressed an interest and information you submit in connection with a quote or service request.
  • Approximate location information, such as location inferred from IP address, and location information you voluntarily provide, such as ZIP code.
  • Communications and request information, including messages, inquiries, privacy requests, consent records, and records of communications with us or participating providers.
  • Other information you choose to provide through an advertisement, lead form, landing page, website, or communication with us.

We do not intentionally collect Social Security numbers, account passwords, biometric identifiers, precise geolocation, consumer health data, or other sensitive personal data unless expressly disclosed to you and necessary for a specific service. Where applicable law requires consent for sensitive data, we will obtain it before processing.

2. Sources of Personal Information

  • Directly from you, including when you complete a form, request information, respond to an advertisement, or communicate with us.
  • From Avanto advertisements, websites, landing pages, cookies, pixels, and similar technologies.
  • From advertising platforms, publishers, affiliates, and referral partners when you interact with Avanto-related advertising or lead-generation experiences.
  • From service providers and business partners that support our advertising, analytics, communications, security, lead management, call routing, and related operations.

3. How We Use Personal Information

  • Respond to requests and provide information about products or services in which you expressed an interest.
  • Connect consumers with participating businesses, advertisers, agents, or service providers that may be able to respond to a request.
  • Operate, maintain, secure, troubleshoot, and improve the Services.
  • Measure advertising, campaign, affiliate, and conversion performance.
  • Prevent fraud, invalid traffic, abuse, security incidents, and other misuse.
  • Maintain consent, suppression, privacy-request, and compliance records.
  • Comply with legal, regulatory, contractual, and reporting obligations and protect our rights and the rights of others.
  • Conduct internal analytics, quality assurance, and business operations consistent with this Policy.

4. Advertising and Social Media Platforms

We may advertise through third-party websites, search engines, social media platforms, publishers, and advertising networks. When you view, click, or otherwise interact with an Avanto advertisement, we may receive information about that interaction, including campaign or referral information, device or browser information, IP address, and online activity information. If you submit information through an advertisement, lead form, landing page, or other service, we may receive the information you choose to provide. We do not offer consumer social-login accounts unless expressly stated at the point of collection.

5. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients as reasonably necessary for the purposes described in this Policy:

  • Participating businesses, advertisers, agents, and service providers. When you request information about a product or service, we may disclose the information you provide to one or more participating businesses or service providers that may contact you regarding that request.
  • Service providers and processors that support lead management, call tracking and routing, hosting, analytics, communications, advertising, security, credential management, productivity, and other business-support functions.
  • Affiliates and corporate transaction counterparties, where applicable, including in connection with a merger, financing, acquisition, reorganization, bankruptcy, or sale of assets.
  • Government authorities, regulators, courts, or other parties when required by law or reasonably necessary to protect rights, safety, security, or prevent fraud or abuse.

Our applicable vendor agreements include data-protection and confidentiality requirements appropriate to the services provided.

6. Sale, Sharing, and Targeted Advertising

Some U.S. state privacy laws define “sale” broadly and define “sharing” or “targeted advertising” to include certain disclosures or uses of personal information for advertising, even where no money is exchanged. Because Avanto may disclose lead information to participating providers and may use advertising technologies, certain activities may be considered a sale, sharing, or processing for targeted advertising under applicable law.

Where required, you may opt out through our Your Privacy Choices page. We also honor qualifying universal opt-out mechanisms, including Global Privacy Control (GPC), where required by applicable law. We do not sell sensitive personal data, and we do not knowingly sell or share personal information of individuals under 18.

7. Cookies and Similar Technologies

We and our service providers may use cookies, pixels, web beacons, local storage, and similar technologies to operate the Services, remember preferences, measure traffic and campaign performance, prevent fraud, and support advertising. Where consent is required, non-essential cookies will not be used until consent is obtained. You can manage applicable choices through our Cookie Preferences tool at avanto.media/privacy-choices. Browser settings may also allow you to block or delete cookies, although doing so may affect functionality.

8. Data Retention

We retain personal information only for as long as reasonably necessary and proportionate to the purposes for which it was collected or processed, taking into account legal, regulatory, contractual, accounting, fraud-prevention, dispute-resolution, and reporting requirements. Retention periods may vary by data type and processing purpose. Avanto maintains a formal Data/Record Retention Policy governing retention and secure disposal. When information is no longer required, we delete, anonymize, or securely dispose of it as appropriate.

9. Security

We maintain administrative, technical, and organizational safeguards designed to protect personal information. These safeguards include, as appropriate, multi-factor authentication, least-privilege access, company-managed devices, endpoint protection, credential management, data-loss-prevention controls, encryption in transit and at rest where supported, access reviews, employee training, incident-response procedures, and vendor-risk controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. International Data Transfers

Avanto is based in the United States, and personal information may be processed in the United States and in other countries in which our service providers operate. Where the EU GDPR, UK GDPR, or Swiss FADP applies to an international transfer, we use an appropriate transfer mechanism when required, which may include an adequacy decision, applicable standard contractual clauses, the UK International Data Transfer Agreement or UK Addendum, or another legally permitted mechanism. 11. U.S. State Privacy Rights

Depending on where you reside and whether the applicable law covers Avanto or the processing at issue, residents of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia may have some or all of the following rights:

  • Confirm whether we process personal information and access or obtain a copy of that information.
  • Correct inaccuracies in personal information.
  • Delete personal information, subject to legal exceptions.
  • Obtain a portable copy of certain personal information.
  • Opt out of the sale of personal information, sharing for cross-context behavioral advertising where applicable, or processing for targeted advertising.
  • Opt out of certain profiling in furtherance of decisions that produce legal or similarly significant effects, where applicable.
  • Withdraw consent for certain processing where consent is the legal basis.
  • Appeal a decision we make regarding a privacy-rights request where state law provides an appeal right.
  • Exercise privacy rights without unlawful discrimination or retaliation.

12. California Supplemental Notice

This section supplements the remainder of this Policy for California residents and is intended to address the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”).

In the preceding 12 months, Avanto may have disclosed the categories above for business purposes. Depending on the circumstances, Avanto may have sold or shared, as those terms are defined by the CCPA, identifiers, internet/electronic network activity, and commercial or preference information in connection with lead distribution and advertising activities. Avanto does not sell or share sensitive personal information for purposes that would require a right to limit under the CCPA unless separately disclosed.

California residents may have the right to know/access, delete, correct, opt out of sale or sharing, limit certain uses/disclosures of sensitive personal information where applicable, and receive nondiscriminatory treatment. We honor qualifying opt-out preference signals such as GPC where required. Authorized agents may submit requests as permitted by law, subject to verification of authority and identity.

California residents may also make a request under California’s “Shine the Light” law, if applicable, regarding certain disclosures for third-party direct marketing by contacting privacy@avanto.media.

13. Additional State-Specific Disclosures

Maryland residents: Avanto does not sell sensitive personal data. We process personal data only to the extent reasonably necessary and proportionate to provide or maintain the product or service requested, or for another purpose permitted by applicable law.

Oregon residents: Where required, you may request a list of specific third parties to which we disclosed your personal data by using the Consumer Privacy Rights Request Form.

Colorado and other states recognizing universal opt-out mechanisms: We process qualifying GPC or other recognized universal opt-out signals as requests to opt out of applicable sale or targeted-advertising processing.

14. Canada and Quebec

If you are a resident of Canada, Avanto processes personal information in accordance with applicable Canadian private-sector privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, provincial privacy laws such as those in Alberta, British Columbia, and Quebec.

Canadian Privacy Principles. Avanto identifies the purposes for collecting personal information at or before collection, limits collection to information reasonably necessary for those purposes, uses and discloses information for identified purposes or as otherwise permitted by law, maintains reasonable safeguards, limits retention, and provides individuals with access and correction rights as required by applicable law.

Consent and Lead Sharing. When you submit information through an Avanto advertisement, website, landing page, or lead form, we may use and disclose that information to respond to your request and to connect you with participating businesses or service providers that may contact you about the product or service in which you expressed an interest. Where Canadian law requires consent, we will seek consent in a form appropriate to the sensitivity of the information, the reasonable expectations of the individual, and the nature and consequences of the collection, use, or disclosure. You may withdraw consent, subject to legal or contractual restrictions and reasonable notice. Withdrawal may affect our ability to provide a requested service.

Canadian Privacy Rights. Subject to applicable law and exceptions, you may request access to personal information we maintain about you, information about its use and disclosure, correction of inaccurate or incomplete information, and withdrawal of consent where consent is the basis for processing. You may also challenge Avanto’s compliance with applicable Canadian privacy requirements.

International Processing. Avanto is based in the United States. Personal information relating to Canadian residents may be processed, stored, or accessed in the United States or other jurisdictions in which our approved service providers operate and may therefore be subject to the laws of those jurisdictions. Avanto remains responsible for personal information under its control and uses contractual, organizational, and technical safeguards appropriate to the processing.

Quebec Residents. Where Quebec’s private-sector privacy law applies, Avanto will provide the notices and obtain the consents required by that law. Quebec residents may request access to or correction of their personal information and may contact Avanto’s person responsible for the protection of personal information using the contact information below. Before communicating personal information outside Quebec, where required, Avanto will conduct an assessment of privacy-related factors and use a written agreement designed to provide appropriate protection for the information.

Exercising Canadian Rights and Complaints. Submit a request using our Consumer Privacy Rights Request Form at avanto.media/privacy-request or email privacy@avanto.media. We will respond within the period required by applicable law. If you are not satisfied with our response, you may have the right to complain to the Office of the Privacy Commissioner of Canada or the applicable provincial privacy regulator, including Quebec’s Commission d’accès à l’information.

15. EEA, UK, and Switzerland

If the EU GDPR, UK GDPR, or Swiss FADP applies to our processing of your personal data, the following additional information applies.

Where we rely on legitimate interests, those interests may include operating and securing the Services, preventing fraud, measuring performance, responding to requests, maintaining records, and protecting our legal and business interests, balanced against your rights and interests.

Subject to applicable law, you may have rights to access, rectify, erase, restrict processing, object to processing, obtain data portability, and withdraw consent at any time where processing is based on consent. You also have the right to object at any time to processing of personal data for direct marketing.

Avanto does not use solely automated decision-making, including profiling, that produces legal or similarly significant effects on individuals in connection with the Services covered by this Policy.

EEA residents may lodge a complaint with the supervisory authority in their country of residence, place of work, or where an alleged infringement occurred. UK residents may complain to the UK Information Commissioner’s Office. Swiss residents may contact the Swiss Federal Data Protection and Information Commissioner. You may also contact us first at privacy@avanto.media so we can attempt to resolve your concern.

16. Children and Minors

The Services are intended for adults and are not directed to children under 18. We do not knowingly collect personal information from children under 18 through the Services. If we learn that we collected information from a child in circumstances prohibited by law, we will take reasonable steps to delete it. Contact privacy@avanto.media if you believe a child has provided personal information to us.

17. Exercising Privacy Rights, Verification, and Appeals

You may submit a privacy request using the Consumer Privacy Rights Request Form at avanto.media/privacy-request or by emailing privacy@avanto.media. We may request information reasonably necessary to verify your identity, locate responsive records, prevent fraudulent requests, and determine your jurisdiction. We will use verification information only for those purposes and other legally permitted purposes.

If you use an authorized agent, we may request documentation showing the agent’s authority and may ask you to verify your identity directly where permitted. If we deny a request and applicable state law gives you a right to appeal, you may select “Appeal a Privacy Request Decision” on our form or email privacy@avanto.media with the subject line “Privacy Appeal.”

We will respond within the period required by applicable law and may extend the response period where legally permitted. We generally do not charge a fee unless permitted by law, such as for manifestly unfounded, excessive, or repetitive requests.

18. Marketing Choices

You may unsubscribe from marketing emails using the unsubscribe link in the message. You may opt out of marketing text messages by replying STOP, where applicable. These choices do not prevent service, transactional, legal, or privacy-related communications. 19. Changes to this Policy

We may update this Privacy Policy from time to time. We will post the updated Policy and revise the “Last Updated” date. If changes are material, we will provide additional notice where required by law. We review this Policy at least annually and when material changes to our data practices occur.
